THIS AGREEMENT WILL BE FULLY REVIEWED AND ACCEPTED BY CUSTOMER AT THE TIME OF PURCHASE. CUSTOMER, AND ALL OTHER GUESTS LISTED ON THE ORDER, WILL ALSO BE REQUIRED TO PHYSICALLY OR DIGITALLY SIGN A COPY OF THIS AGREEMENT PRIOR TO THEIR DATE OF ARRIVAL. THE EVENT TERMS & CONDITIONS IS SUBJECT TO CHANGE PRIOR TO THE EVENT DATE AND CUSTOMER WILL BE NOTIFIED IN ADVANCE OF ANY SUCH CHANGES.
Overview of Terms and Conditions
This serves as an overview of the terms and conditions contained in this agreement; this paragraph does not cover all terms listed or details of terms listed, but rather a highly abridged version of some of the points listed below.
No refunds. All sales are final. (See Cancellation Policy)
You must have a valid passport (and potentially other documents) to enter into the country of Mexico.
Event is subject to change (itineraries, lineup/artists/performers, dates, times, location, prices etc.), and Event retains the right to modify, reschedule or even cancel your reservation and/or event at any time for any reason, including force majeure, Covid-19 or other pandemic/epidemic related protocols or laws, or any other reason; in the case of event cancellation, you may offered a partial refund, full refund, no refund, or rescheduled event, at the sole discretion of the Event.
You must follow all laws and regulations, including Covid-19 and other health guidelines in place at the time of the event.
You are responsible for paying applicable taxes.
Ticket and matching Valid ID must be used for entry.
All attendees are subject to a security check at the event and are not allowed to bring any prohibited items.
No unauthorized ticket resales or transfers.
Zero tolerance drug or violence policy at the event.
You must follow our “Code of Conduct” at the event.
Event is not responsible for 3rd party vendors such as; shuttles, ground transportation, airfare, hotels, excursions or vendors.
Photography is permitted for personal use only, and is not allowed during most performances, unless stated otherwise. Videos and flash photography are strictly prohibited inside the venue. Attendees may not bring professional photography/audio recording or video equipment.
Anyone entering the event consents to being recorded, filmed and photographed and has granted permissions to the Event to depict or otherwise use their image, likeness, voice, and actions as embodied in such photographs(s), recordings, film and/or video in perpetuity. You acknowledge there are risks and dangers of attending an event and indemnify the Event and all related companies from any such accidents, injuries, death, loss, cost, claim, delay, or damages of any kind related to your purchase of or attendance to the event.

Relationship of Parties
This Agreement is between you (“You” or “Guest” or “Customer”), on the one hand, and the authorized ticket seller, (“Company” ) on the other, in connection with the music festival, (“the Event”) taking place on the advertised dates (“Event Date”) and location (“Resort” or “Hotel”) that you have purchased. You expressly acknowledge and agree that (a) you are purchasing ticket(s) for this Event with the Company’s authorized seller; a third-party marketing agent for the Event only, which serves as the ticketing agent for the Company; (b) the Company’s authorized seller is not responsible or liable to you for any claims, damages, or other liability arising from or related to the Event in any manner whatsoever.
You are purchasing tickets for this Event with the Company’s authorized seller, which is not affiliated with the Venue, but rather serves as a third-party marketer and ticketing for the Company in connection with the Event.
The Company’s authorized seller is not responsible, or liable to you, for any loss, damage, injury, or any other claims or expenses arising from or related to the Event. Your decision to make payment in connection with the Event to purchase an Event ticket constitutes your acknowledgment of and consent to all the terms and conditions set forth herein, including the limitations of liability respecting the the Company’s authorized seller. Any disputes and claims whatsoever related to or involving the Company’s authorized seller shall be governed by California law. Your acceptance of this agreement also constitutes your acknowledgement and agreement that any action related to this agreement, the Company, and/or the Event, can be brought and maintained only in the courts located in Los Angeles County, California.
You are fully aware that at the time of your booking, the worldwide Covid pandemic threat has diminished significantly. However, it may, or may not, have a resurgence and may have an impact on your experience at the time the Event takes place. If that occurs, you agree to follow all Covid protocols that are in place at the time of the Event and have read the current protocols listed at the bottom of these Terms of Service.
Your digital acceptance of these Terms constitutes your acknowledgment of and consent to all of the purchase terms set forth below, including the limitations of liability which are part of the Event Terms and Conditions that you reviewed and accepted on the website at the time of purchase. Any disputes and claims whatsoever related to or involving the Event shall be governed by California law. Your signature of this agreement also constitutes your acknowledgement and agreement that any action related to this agreement, the Event, can be brought and maintained only in the courts located in Los Angeles County, California.
Cancellations and Recommendation for Purchase of Travel Insurance
Payments for the Event are non-refundable. If you decide not to attend, or are prohibited from attending due to illness, travel delays, or any reasons whatsoever, the Event is under no obligation to refund any monies received from you. The Event shall not provide, nor be responsible to provide, any refunds for unused tickets, or cancellations for those who do not show up in time for any or part of the event for any reason whatsoever after the start of Event.
The Event does not provide travel insurance. The Event has very strict cancellation policies and each recommends that You purchase travel insurance from a third party to protect your trip and any payment or deposit you make. The Event does not offer or sell travel insurance, and it is your responsibility to obtain travel insurance at your discretion. If you do not choose to purchase travel insurance you are agreeing to be 100% responsible for the complete forfeiture of all monies and fees paid to Event should you be unable to attend the event, for whatever reason.
Event Reschedule and/or Changes
If the Event is cancelled and/or rescheduled because of a circumstance or occurrence outside the control of Event, including but not limited to force majeure events (such as acts of nature, fire, earthquake, government imposed travel bans, pandemics, terrorism etc.) which cancellation and/or rescheduling shall be made in Event's sole and exclusive discretion, Event shall not be liable to you for any damages or expenses. If the Event is rescheduled due to any of the circumstances listed above, Event will transfer you to the rescheduled Event. If You are unable to attend the rescheduled Event, Event will allow you up to 2 years (from the date of the initial Event) to transfer 100% of your funds to a future Event without penalty.
The Event reserves the right, at any time, to modify, change, postpone or abandon all or any part of the Event in its sole and exclusive discretion. The Event will NOT be responsible for any loss or expense caused by reason of such changes, modifications or abandonment. Event shall not refund any of your purchase price or any other charges by guests who decide not to attend through the duration of the event for any reason or cause whatsoever. Unforeseen illnesses, circumstances, and contingencies may arise causing a cancellation by a band or other talent booked for the Event. Under these circumstances, the Event reserves the right in its sole and exclusive discretion to alter or cancel the band(s) contracted for and/or advertised for this Event. Event reserves the right to change the itinerary, schedule, and/or lineup and change the venue and find a reasonable or suitable alternative in its sole discretion; and in such event Event shall not be responsible and/or liable to you whatsoever including but not limited to, for any compensatory or consequential damages.
Refunds
The only instances when refunds are allowed are for accidental overpayments on accounts. In such cases, Event will only issue refunds via check. No refunds will be issued to credit cards. All refund checks will be sent by first class US mail and require at least 7-10 days for delivery. The Event may require written certification of identity in order to issue any such refunds for overpayments.
The Event is a rain or shine event, please come prepared!
Travel Documents
ALL GUESTS ARE REQUIRED TO HAVE A VALID PASSPORT - NO EXCEPTIONS. You will be traveling outside of the country for this event and it is MANDATORY that you have a valid passport (unless you live in the country where the Event is taking place).
You may have to obtain visitors visas or other country requirements, which is not the responsibility of the festival to inform you of. Please do your research to be informed of any documents you need to obtain based on your country of residence to enter into Mexico.
Credits
Customers that may have a negative balance, or “credit” on their account for any reason, will not receive refunds. The “credit” will remain on the customer’s account to be used towards future purchases, subject to applicable time limitations.
Artist Lineup
The Artist Lineup is subject to change without notice. You acknowledge that regardless of any change in lineup, the terms of this agreement remain in full effect, and you will not be entitled to any refunds if you wish to cancel your reservation.
Tickets
Tickets include all main stage concerts taking place at the resort during the Event only. Tickets do not include rooms, ground transportation, flights, all-inclusive meals and drinks, activities and excursions, and Resort offerings. Packages may be purchased separately with a bundle of various items, listed in product description.
Service Fees
Per-person Service Fees will be applied and added to the order at the time of booking and subject to every guest attending the Event.
Seating
Seat sections are selected by you at the time of booking. Precise seats will be assigned after purchase by the box office on a best available basis at the time of booking.
Ownership Changes
An ownership change will be subject to a $25 fee. No ownership changes will be accepted 30 days prior to the scheduled arrival date.
Upgrades or Downgrades
Upgrading your seating category is permitted at any time prior to the Event while supplies last.
Upgrade Cost: When you upgrade your seats we will charge the card on file that is listed as the default.
Requests to an upgrade to your reservation can be done by contacting our Box Office
Downgrading your seating category is not permitted. A downgrade is defined as a seat of a less expensive per person category, or from higher number of seats to a lower number.
Charge Backs & Disputes
All charges to your credit card will be labelled as the name of the Event. If you feel that you have been charged in error, you are requested to call or email the Company first to discuss the issue and allow Company a reasonable time to resolve it. If you fail to call or email and dispute the charge with your bank, then Company reserves the right to place your account in a “canceled” status. Canceled accounts fall under the Company's "NO REFUND" policy.
Health Considerations
Persons who have a physical or mental disability or a medical condition must report them to the Company IN WRITING VIA EMAIL AT THE TIME THE RESERVATION IS MADE or at the time the medical condition is discovered, whichever comes first.
ADA Accommodations
If you will require special assistance at the event or need wheelchair accessible seating, please contact us PRIOR to booking your tickets. We have special reserved seats/sections which are wheelchair accessible, which are not available to purchase online without a special ticket link. We do our best to accommodate all types of disabilities, so please don’t hesitate to contact us with any questions or concerns. However, please note that the country of Mexico has different laws regarding disabilities than the USA or Canada, please do your research based on your specific disability to ensure proper sized wheelchairs, aids or service animals will be admitted prior to your trip.
Service Animals
The Event does not allow any kind of pets, or therapy or emotional support animals. To be classified as a service animal, the guest must advise Company in writing via email within 15 calendar days of booking. The guest will be required to provide any and all documentation requested by the Event, the Resort, U.S. Customs and Immigration, and any local or other applicable customs and immigration authorities. In addition, the guest will be required to sign a waiver and may also be subject to certain limitations in regards to accessing areas of the concert viewing areas.
Age Minimum
Guests must be 18 years or older to be admitted to the Event, unless accompanied by an adult.
Refusal of Entry/Termination of Trip or Event
The Company reserves the right, without refund of any portion of the price paid or other compensation to you, to refuse admission or to eject any person from the Event, and/or withdraw or refuse to begin services or provide goods to any person, who fails to comply with Company’s zero tolerance policy or is otherwise disorderly or conducting themselves in a way that is in violation of the rules of an applicable third party (resort, hotel, DMC, tour operator, supplier, excursions company, ground transportation provider, etc.) and/or applicable local, state or federal law or ordinance, in whole or in part, or whose conduct is deemed by Company or the applicable third party as illegal, disorderly, vulgar, abusive, threatening, aggressive, or out of compliance with this policy or the applicable third party’s terms, conditions, rules or policies.
The Company may, in its sole and exclusive discretion, require any person to withdraw from the Event if it is deemed that your or such person's actions or conduct is offensive, disorderly and/or a nuisance, and in such event the Company shall have no liability to you or such other person as a consequence of the early or other termination of your trip and/or event, or be required to pay you any refund.
Photography/Video Release
Video or audio recording, filming, or photographs may occur at the Event which may be owned, licensed, assigned, or distributed nationwide and worldwide by the Resort, the Company, their affiliates or assignees. By acknowledging these Terms & Conditions at the time of booking a reservation for the Event, you acknowledge, and agree that the Company, the Resort, and their affiliates and assignees, are granted and authorized to use your likeness and/or appearance on any film, video, or other media or video format now known or hereinafter developed, in any manner whatsoever. Other than in connection with the Event, the Company, and/or the Resort, no such picture or footage including your image shall be used in a manner that directly implies your sponsorship or support of any product, service, company, or political cause. You will not receive any compensation for any such use, and waive any right to bring any action in law or equity against the Company, the Resort, their affiliates or assignees arising from the use of your image or likeness.
Photography and Video Policy
Video recording is strictly prohibited at the Event. No professional photography equipment may be used unless approved in advance and in writing by the Company. Small handheld cameras without interchangeable lenses are acceptable for personal use only. DSLR's (Digital Single Lens Reflex Cameras) are not allowed for guest use at the event. Commercial use of photography and video is strictly prohibited.
Zero Tolerance Policy
In accordance with local, state, federal and international laws, the Company maintains a strict zero tolerance policy regarding the illegal use, possession, purchase, or distribution of controlled substances. Any violation of this policy will result in immediate ejection from the Event as well as the individuals being turned over to the local law enforcement officials for appropriate legal action. In such cases the Company shall not be liable for any refund or other compensation or damages, and reserve the right to refuse entry at any future Events.
We expect all of our attendees to abide by and conduct themselves in a respectable manner. Verbal threats, repeated foul language, pushing/hitting/poking/grabbing of any kind, hate symbols, throwing any items onstage or any other violence will result in immediate removal from the event and revoking of tickets without refund. Any violence that is deemed unlawful will involve local authorities.
Attendees may not display or make texts, symbols, images, gestures, wear clothing or articles of dress which, in the sole discretion of Event staff or security personnel, contain and/or display language and/or images which are obscene, racist, xenophobic, provocative, hate speech or discriminatory.
Prohibited Items
Any and all prohibited items found may be seized and/or the attendee denied entry. Prohibited items include, but are not limited to; weapons of any kind (or anything that could be used as a weapon), illegal drugs or substances, prescription drugs not in the name of the attendee or above the allowed limit, personal alcohol, professional photography/audio/filming equipment, animals (except registered service animals, pursuant to local regulations), drones, fireworks or flares, laser pens or laser pointers, pocketknives, fuel, spray paint or other paint, stickers, unauthorized promotional material, speakers, flags, large umbrellas, signs or posters larger than 24” x 24”, scooters or bikes (unless for a disability), tripods or monopods, outside food or drinks, luggage, bags larger than 24” x 12”, credit card machines, aerosols/aerosol cans, artificial noise makers, obscene clothing that may cause a disturbance to the other attendees, and any other items deemed as posing a threat to the safe enjoyment of the event.
Vending
NO VENDING OF ANY KIND IS ALLOWED at the Event. This means, DO NOT make t-shirts, hats, posters, jewelry, or anything else to sell at the Event. Any and all unauthorized merchandise will be confiscated. This policy will be strictly enforced.
Responsibility and Limitation of Liability
The Company provides only third-party concert ticket sales at the Resort for the Event. The Company shall not be liable or responsible for any injury, property damage, loss, delay, inconvenience, or other fees, costs, or expenses caused in whole or in part by the negligence, acts, errors, or omissions, on the part of any third party, or any supplier of services of goods or of agents selected by you or your travel agent. This includes but is not limited to any Customer's stay at the Resort or property in connection with the Event, any pre and post nights added to reservations for the Event, and related travel.
Resort and/or other third-parties may require you to present a credit card or cash deposit upon check-in to cover incidentals and additional expenses incurred during your stay. Such deposit is unrelated to any payment received by Company in connection with the Event or related transaction.
You acknowledge that third parties offering certain services and/or activities may require you to sign their own liability waivers prior to participating in the service and/or activity they offer. You understand that any violation of any such third party’s rules and restrictions may result in cancellation of your reservation(s) for the Event, in your being denied access to the Event, in your forfeiting any monies paid for such reservation(s), and/or in the Company debiting your account for any costs incurred as a result of such violation. The Company is not liable for the acts, errors, omissions, representations, warranties, breaches, or negligence of any such third parties or for any personal injuries, death, property damage or other damages or expenses related therein.
It is understood and acknowledged that the Company is an outside, independent entity and does not own, retain, or have any control over the Resort or property or properties where the Event take place, and that the Company is unaffiliated with and has no control over third-party contractors or service providers. By participating in and attending the Event, you voluntarily assume all risks of loss, damage, or injury while at the Event and at any resort, hotel, or related properties. You acknowledge and agree that the Company is not liable, and that no claim shall be asserted against the Company for, or arising from any liability, injury, loss or damage to property, injury, or death, including any attorney's fees, that may be sustained by you at or in connection with the Event. This release shall be binding upon you, and your heirs, next of kin, executors and personal representatives.
A reservation/ticket to the Event is a revocable license.
Your Representations and Warranties
Without limiting anything set forth in this agreement, you hereby represent and warrant that (a) you will not violate any applicable laws, ordinances and/or regulations at or in connection with the Event and/or activities corresponding to your transactions with Company and/or via the ticketing website; (b) you are of sufficient legal age and authority to enter into any transaction with Company and/or via the ticketing Website, to attend the Event, and to create legal binding obligations for any liability you may incur as a result of entering into this agreement; (c) you are an authorized user of the credit or debit card used to enter into any transaction with Company and/or via the ticketing website; (d) you shall at all times be in compliance with any and all terms, conditions, policies and rules set forth by Company and/or any applicable third party; (e) you have obtained any and all passports, visas, health information and/or other permission necessary in connection with your transaction with Company and/or via the ticketing website; and (f) you have been provided the opportunity to seek independent legal counsel in connection with this agreement, and that by accepting it (signing) you represent and warrant that you understand all of the foregoing terms and agree to them.
You agree that any dispute, claim, or controversy that you claim relating in any way to (a) the terms and conditions, (b) your use of the site, (c) products or tickets sold, distributed, issued or redeemed, or (d) the event, irrespective of when that dispute, claim or controversy arose, unless otherwise solvable by informal dispute resolution (see below) between You and Us, will be resolved solely by binding, individual arbitration in Los Angles, California, as set forth in these terms, rather than in court. You hereby waive any right to a jury trial, and agree that you may bring claims against us only in an individual capacity, and not as a plaintiff or class member in any purported class or respective proceeding. Unless applicable law provides otherwise, the arbitration proceeding and all records pertaining to it—including but not limited to any documents prepared or produced in connection with the arbitration proceeding, as well as the hearing and the arbitration award—will be confidential and will not be disclosed to any third party, except as necessary to obtain court confirmation of the arbitration award.
You understand that We (the Event and Covered Parties) are able to bring lawsuits against You if we see fit, or choose to resolve the manner with arbitration or other ways.
In no event shall the Company Parties be liable for any claim unless written notice is given within six (6) months from the date of the loss. No suit for any cause may be maintained against the Company Parties unless it is commenced within one (1) year after the Event. The parties hereto specifically consent to personal jurisdiction in the State of California.
YOU HEREBY ACKNOWLEDGE AND AGREE THAT ANY DISPUTE IS LIKELY TO INVOLVE COMPLICATED AND DIFFICULT ISSUES, AND THEREFORE, YOU KNOWINGLY, VOLUNTARILY, INTENTIONALLY, IRREVOCABLY AND UNCONDITIONALLY WAIVE ANY RIGHT YOU MAY HAVE TO A TRIAL BY JURY IN RESPECT OF ANY DISPUTE OR CONFLICT IN CONNECTION WITH THIS AGREEMENT. If any provision of this Agreement is found to be invalid or unenforceable, that provision shall be enforced to the maximum extent possible so as to effect the intent of the parties hereto, and the other provisions contained herein will remain in full force and effect. Company’s failure to insist upon or enforce any provision of this Agreement shall not be construed as a waiver of any provision or right.
Informal Dispute Resolution. You and we each recognize and agree that good faith, informal efforts to resolve disputes often result in prompt, low-cost, and mutually beneficial outcomes. Customer satisfaction is our number one goal. To that end, Site and Event are committed to resolving disputes with its customers in a fair and efficient manner. Therefore, you and we each agree that, before either of us may commence an arbitration or assert a claim in small claims court, you and we will engage in the following informal dispute resolution process:
Prior to commencing any arbitration related to this Agreement, you agree that if you have a dispute with Site or Event, you must first contact our Customer Service Department at: info@cabojazzfest.com
Our team will respond within thirty (30) days with a response. We will use best efforts to resolve the issue with you and come to a reasonable conclusion. All offers, promises, conduct, and statements made in the course of the informal dispute resolution process by any party, its agents, employees, and attorneys are confidential and not admissible for any purpose in any subsequent proceeding, provided that evidence that is otherwise admissible or discoverable shall not be rendered inadmissible or non-discoverable as a result of its use in the informal dispute resolution process. Any and all information shared during the informal dispute process will remain confidential and will not be disclosed to any third party.
If the dispute cannot be settled through informal dispute resolution and/or other negotiations, the parties agree first to try in good faith to settle the dispute by mediation administered by the American Arbitration Association under its Commercial Mediation Procedures before resorting to arbitration, in Los Angeles, California. If a party fails to respond to a written request for mediation within 30 days after service or fails to participate in any scheduled mediation conference, that party shall be deemed to have waived its right to mediate the issues in dispute. If the mediation does not result in settlement of the dispute within 30 days after the initial mediation conference or if a party has waived its right to mediate any issues in dispute, then any unresolved controversy or claim arising out of or relating to the Event or these Terms and Conditions or breach thereof shall be settled by arbitration administered by the American Arbitration Association in accordance with its Commercial Arbitration Rules, before one arbitrator, in Los Angeles, California. Judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction thereof. The venue for any mediation or arbitration shall be Los Angeles, California, and only the substantive laws of the State of California shall apply.
If the matter is still not resolved to your satisfaction, then you agree to begin arbitration by submitting a Demand for Arbitration to the American Arbitration Association. You further agree that exclusive jurisdiction for any such arbitration shall be Los Angeles, California.
The arbitrator, and not any federal, state, or local court or agency, shall have exclusive authority to resolve any dispute arising out of or relating to the interpretation, applicability, enforceability or formation of this Agreement, including, but not limited to, any claim that all or any part of this Agreement to arbitrate or the Terms is void or voidable. The arbitrator will decide the substance of all claims in accordance with the laws of the state of California. The arbitrator's award will be final and binding, and judgment on the award rendered by the arbitrator may be entered in a court having jurisdiction thereof.
Governing Law/Jurisdiction/Attorneys' Fees and Costs
This agreement is governed by the laws of the State of California. Any action or proceeding, involving the parties and arising out of this agreement shall be brought and maintained only in the state or federal courts located in Los Angeles County, California. The prevailing party in any such action or proceeding shall be entitled to the recovery of reasonable attorney’s fees and costs incurred in connection therewith.
Severability
If any term of this agreement is to any extent illegal, otherwise invalid, or incapable of being enforced, such term shall be excluded to the extent of such invalidity or unenforceability. All other terms shall remain in full force and effect and, to the extent permitted and possible, the invalid or unenforceable term shall be deemed replaced by a term that is valid and enforceable and that comes closest to expressing the intention of such invalid or unenforceable term. If application of this severability provision should materially and adversely affect the economic substance of the transactions contemplated hereby, the party adversely impacted shall be entitled to compensation for such adverse impact, provided the reason for the invalidity or unenforceability of a term is not due to serious misconduct by the party seeking such compensation.
Counterparts
This Agreement may be executed in separate counterparts, each of which shall be considered an original but all of which shall constitute one agreement. Original signatures shall not be necessary; but, rather, you may deliver to Company a signed copy of the agreement via facsimile machine or electronically, which shall have the same binding effect as if original signed agreement had been delivered.
COVID-19 INFORMATION, RULES, and LIABILITY RELEASE
You agree to follow all applicable local laws and medical, health, and safety, guidelines, which may or may not be in place at the time of the Event, including the following:
MASKS.
At the time of the event, masks may be required in all concert performance areas. If a mask requirement is in effect, failure to wear a mask during any Event in any public area can result in your removal from the area and/or ejection from the Event if you refuse to wear a mask. No refunds will be issued if you are removed from any Event or any show because of your failure or refusal to wear a mask.
You agree to be temperature checked prior to entering or exiting any concert venues. If you have a temperature, your entrance to the subject area may not be allowed.
SAFETY INFORMATION.
Because Covid is extremely contagious and is spread mainly from person-to-person contact, the Company has put in place preventative measures to reduce the spread. However, the Company cannot guarantee that the Event participants, volunteers, partners, or others in attendance will not become infected with Covid.
DUTY TO SELF-MONITOR.
Participants agree to self-monitor for signs and symptoms of Covid (symptoms typically include fever, cough, and shortness of breath) and, if participants display obvious symptoms during a concert event, they may be required to either wear a mask, or if they do not comply, may be asked to leave the concert out of respect and safety of other patrons.
LIABILITY WAIVER AND RELEASE OF CLAIMS.
You acknowledge and agree that you derive personal satisfaction and a benefit by virtue of your participation and/or attendance at the Event, and willingly engage and attend the Event and related activities.
RELEASE AND WAIVER:
I HEREBY RELEASE, WAIVE AND FOREVER DISCHARGE ANY AND ALL LIABILITY, CLAIMS, AND DEMANDS OF WHATEVER KIND OR NATURE AGAINST THE COMPANY AND ITS AFFILIATED PARTNERS AND SPONSORS, INCLUDING IN EACH CASE, WITHOUT LIMITATION, THEIR DIRECTORS, OFFICERS, EMPLOYEES, VOLUNTEERS, AND AGENTS (THE “RELEASED PARTIES”), EITHER IN LAW OR IN EQUITY, TO THE FULLEST EXTENT PERMISSIBLE BY LAW, INCLUDING BUT NOT LIMITED TO DAMAGES OR LOSSES CAUSED BY THE NEGLIGENCE, FAULT OR CONDUCT OF ANY KIND ON THE PART OF THE RELEASED PARTIES, INCLUDING BUT NOT LIMITED TO DEATH, BODILY INJURY, ILLNESS, ECONOMIC LOSS OR OUT OF POCKET EXPENSES, OR LOSS OR DAMAGE TO PROPERTY, WHICH I, MY HEIRS, ASSIGNEES, NEXT OF KIN AND/OR LEGALLY APPOINTED OR DESIGNATED REPRESENTATIVES, MAY HAVE OR WHICH MAY HEREINAFTER ACCRUE ON MY BEHALF, WHICH ARISE OR MAY HEREAFTER ARISE FROM MY ATTENDANCE AND/OR PARTICIPATION IN THE EVENT AND RELATED ACTIVITIES.
ASSUMPTION OF THE RISK.
Participation/attendance includes possible exposure to and illness from infectious diseases including but not limited to Covid. While particular rules and personal discipline may reduce this risk, the risk of serious illness and death does exist;
I knowingly and freely assume all such risks related to illness and infectious diseases, such as Covid, even if arising from the negligence or fault of the Released Parties; and
I hereby knowingly assume the risk of injury, harm and loss associated with the Event and related activities, including any injury, harm and loss caused by the negligence, fault or conduct of any kind on the part of the Company.
I acknowledge and understand the following:
MEDICAL ACKNOWLEDGMENT AND RELEASE: I acknowledge the health risks associated with the Activity, including but not limited to transient dizziness, lightheaded, fainting, nausea, muscle cramping, musculoskeletal injury, joint pains, sprains and strains, heart attack, stroke, or sudden death. I agree that if I experience any of these or any other symptoms during the Event, I will discontinue my participation immediately and seek appropriate medical attention. I DO HEREBY RELEASE AND FOREVER DISCHARGE THE COMPANY PARTIES FROM ANY CLAIM WHATSOEVER WHICH ARISES OR MAY HEREAFTER ARISE ON ACCOUNT OF ANY FIRST AID, TREATMENT, OR SERVICE RENDERED IN CONNECTION WITH MY PARTICIPATION IN THE ACTIVITY. As a participant or attendee, you recognize that your participation, involvement and/or attendance at any Event or related activity is voluntary and may result in personal injury (including death) and/or property damage. By attending, observing, or participating in the Event, You acknowledge and assume all risks and dangers associated with your participation and/or attendance, and You agree that: (a) the Company (b) the property or site owner of the Event, and (c) all past, present and future affiliates, successors, assigns, employees, volunteers, vendors, partners, directors, and officers, of such entities (subsections (a) through (c), collectively, the "Released Parties"), will not be responsible for any personal injury (including death), property damage, or other loss suffered as a result of or arising from your participation in, attendance at, and/or observation of the Event, regardless if any such injuries or losses are caused by the negligence of any of the Released Parties (collectively, the "Released Claims").
BY ATTENDING AND/OR PARTICIPATING IN THE EVENT AND RELATED ACTIVITIES, YOU ARE DEEMED TO HAVE GIVEN A FULL RELEASE OF LIABILITY TO THE RELEASED PARTIES TO THE FULLEST EXTENT PERMITTED BY LAW.
